Information We Collect From Mobile Devices

We collect limited information from your mobile device upon access of our mobile site or access via our mobile application in order to provide the service you’ve requested. We collect your device type, OS version, date and time stamps of app use, etc. Third party cookies and other such technologies may be deployed within our mobile app only to help us track aggregate statistics such as pageviews, events, etc. We do not capture any other personal information stored on your device and we do not ask for or have access to your location data. We do not share any information provided within the app with third parties for promotional purposes.

Confidentiality and security are extremely important at ParentSavvy. Internet and e-mail security, while constantly improving is not perfect. If you request an e-mail response from us; while we will never knowingly violate your confidentiality, we cannot guarantee the security of our response.

ParentSavvy offers e-mail newsletters with health information about pregnancy, parenting and children’s health topics to consumers who request them. If you choose to provide your e-mail address to ParentSavvy in order to receive e-mail newsletters, you will only receive the e-mail newsletters you have requested.

Indemnification

You agree to indemnify, defend and hold harmless Methodist Health System, its officers, directors, employees, agents, information providers, partners, advertisers and suppliers from and against all losses, expenses, damages and costs, including reasonable attorney’s fees, resulting from any violation of this agreement or any activity related to your account (including infringement of third parties’ worldwide intellectual property rights or negligent or wrongful conduct) by you or any other person accessing ParentSavvy.

Waiver, Release and Limitations of Liability

The Provider shall not be responsible for the information provided herein under any theory of liability or indemnity. Some medical providers who respond to individual inquiries are independent of Methodist Health System and its affiliates and are not employees of Methodist Health System or its affiliates.

Medical providers shall not be held responsible for providing such information under any theory of liability or indemnity. The medical providers who respond to inquiries provide information solely intended to educate and inform. Responses do not create a patient-physician relationship between the answering physician and the individual submitting the request.

The USER agrees to hold harmless and indemnify Methodist Health System and its affiliates and all members of its affiliates’ medical staffs from any and all Claims brought against Methodist Health System or its affiliates or any members of its affiliates’ medical staffs arising from the USER’S use of this website. USER’S OBLIGATION TO DEFEND, HOLD HARMLESS AND INDEMNIFY METHODIST HEALTH SYSTEM AND ITS AFFILIATES AND ALL MEMBERS OF ITS AFFILIATES’ MEDICAL STAFFS SHALL EXTEND TO CLAIMS ALLEGING ACTS OF NEGLIGENCE, FAULT, AND DIRECT OR CONTRIBUTORY INFRINGEMENT ON THE PART OF METHODIST HEALTH SYSTEM OR ITS AFFILIATES OR ANY MEMBERS OF ITS AFFILIATES’ MEDICAL STAFFS. User Representations

You represent and warrant that you are at least 18 (19 where applicable) years of age and that you possess the legal right and ability to enter into this Agreement and to Methodist Health System in accordance with this Agreement. You agree to be financially responsible for your use of ParentSavvy (as well as for use of your account by others, including minors living with you) and to comply with your responsibilities and obligations as stated in this Agreement.

Jurisdiction

This service is not targeted to users in a particular locality, nor is it intended to constitute the doing of business in any jurisdiction, nor to be a solicitation of business anywhere on behalf of Methodist Health System and its affiliates or any members of its affiliates’ medical staffs, nor to constitute any contacts with any jurisdiction outside of the State of Nebraska.

This Agreement is entered-into and performed in the State of Nebraska, United States of America, and is governed by and shall be construed in all respects under the laws of Nebraska, exclusive of its choice of law or conflict of laws provisions. In any claim or action directly or indirectly arising under this Agreement or related to the Service, each party irrevocably submits to the exclusive personal jurisdiction of the Nebraska District Court sitting in Douglas County, Nebraska, or if such court does not have subject-matter jurisdiction, then each party irrevocably submits to the exclusive personal jurisdiction of the United States Court for the District of Nebraska, and whichever of those two courts has jurisdiction, each party waives any jurisdictional, venue, or inconvenient forum objections to such court. If any of the provisions of this Agreement are held by a court or other tribunal of competent jurisdiction not to be enforceable, then such provisions shall be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect. This Agreement constitutes the entire agreement between the parties pertaining to its subject matter. It may not be modified except as described elsewhere in this Agreement. Anything in the Service inconsistent with or conflicting with the terms of this Agreement is superseded by the terms of this Agreement. Methodist Health System may assign its rights and duties under this Agreement to any party at any time without notice to you.

Notice

Methodist Health System may deliver notice to you under this Agreement by means of electronic mail, a general notice on ParentSavvy or by written communication. You may give notice to ParentSavvy at any time by letter delivered by first class postage prepaid U.S. mail or overnight courier to the following address:

Severability

The provisions of this Agreement are severable, and in the event any provision hereof is determined to be invalid or unenforceable, such invalidity or unenforceability shall not in any way affect the validity or enforceability of the remaining provisions.
